Enforcing your Construction Lien
The Michigan Construction Lien Act allows contractors, subcontractors, suppliers and laborers to file a construction lien against property that they have visibly improved. The process is really simple. To file a Construction Lien, the builder must do the following:
- Get a written contract for the goods or services that the builder agrees to supply to the property;
- Obtain a Notice of Commencement from the General Contractor or the Property Owner;
- Provide a Notice of Furnishing to the person named in the Notice of Commencement.
- After having performed his part of the contract, file a Construction Lien and Proof of Service on the property with the register of deeds in the county where the property is located.
- Send a copy of the Construction Lien and Proof of Service to the person named on the Notice of Commencement.
The Construction Lien must be filed within 90 days of the last date of providing goods and services to property.
The process of enforcing a Construction Lien is not nearly as simple as filing one. There are a number of traps that not only can invalidate, but turn it into a claim against.
