Verdict in Brighton Electric v H & R Electric
On Friday, October 6, 2006, Judge Biernat from Macomb County Circuit Court awarded our client a verdict of $247,689.04. Brighton Electric was a wholesale distributor of electrical supplies. H & R is an electrical contractor that does not pay its bills. Case evaluation awarded the Plaintiff only about $10,000. Apparently, the case evaluators were not very impressed with the Plaintiff's case or the prior attorney's preparation of the case (We were hired after this low evaluation award and we replaced prior counsel.).
Success at trial was dependent upon the thorough prepartion of Plaintiff's witness. However, the key to winning the trial was the fact that while the defendant claimed to have had all sorts of set offs...allegedly...the defendant had nothing in writing to show that it was entitled to any set off at all. On cross examination, the defendant's sole witness offered nothing in the way of either documents or testimony to show that the defendant was entitled to any set off.
